Chapter One: Introduction
1.1 Background of the Study
The right to housing is a fundamental human right recognized in both national and international legal frameworks. The Nigerian Constitution guarantees the right to own property and live in a secure environment, but the enforcement of housing rights remains an ongoing challenge, especially in conflict-prone areas like Maiduguri Metropolitan LGA, Borno State (Oluwaseun & Akintoye, 2024). Over the years, displaced persons and impoverished populations have faced severe difficulties in accessing adequate housing. This study will examine how constitutional law supports the right to housing and the challenges faced in ensuring its enforcement in Maiduguri, particularly amidst the effects of insurgency and displacement.
1.2 Statement of the Problem
The lack of adequate housing in Maiduguri is exacerbated by factors such as conflict-induced displacement, poverty, and inadequate governmental intervention. While the Nigerian Constitution protects citizens' property rights, the right to housing remains unfulfilled for many residents in Maiduguri due to inadequate enforcement of legal provisions. This study aims to investigate the effectiveness of constitutional law in addressing the housing crisis in Maiduguri Metropolitan LGA.
1.3 Objectives of the Study
To assess the implementation of constitutional provisions related to the right to housing in Maiduguri.
To identify the challenges in enforcing the constitutional right to housing in Maiduguri.
To propose legal and policy reforms aimed at improving access to housing in Maiduguri Metropolitan LGA.
1.4 Research Questions
How effectively are constitutional provisions on housing implemented in Maiduguri?
What challenges hinder the enforcement of the right to housing in Maiduguri?
What reforms are necessary to improve housing access in Maiduguri Metropolitan LGA?
1.5 Research Hypothesis
H₁: The enforcement of constitutional provisions related to the right to housing is inadequate in Maiduguri due to ongoing security concerns and weak governance.
H₂: The constitutional right to housing remains largely unfulfilled in Maiduguri due to lack of political will and inadequate funding.
H₃: Strengthening legal enforcement and increasing governmental investment in housing development will improve access to housing in Maiduguri.
1.6 Significance of the Study
This study will offer a critical evaluation of how constitutional law can be leveraged to address the housing needs of residents in Maiduguri, particularly those displaced by insurgency. The findings will provide recommendations for policy reforms and practical solutions for enhancing the enforcement of housing rights in conflict-affected regions.
1.7 Scope and Limitations of the Study
The study will focus on Maiduguri Metropolitan LGA, Borno State, and will assess how constitutional law can address the housing crisis in the region. Limitations include challenges in accessing data from displaced persons and local government authorities, as well as the potential effects of ongoing security issues on the availability of accurate data.
1.8 Operational Definition of Terms
Right to Housing: The constitutional right to live in a safe, adequate, and secure environment, including access to affordable housing.
Constitutional Law: The body of laws and legal principles derived from the Nigerian Constitution, including those related to property rights and housing.
Displaced Persons: Individuals who have been forced to leave their homes due to conflict, natural disasters, or other reasons, often lacking secure housing.
